Preamble

These General Terms and Conditions of Sale (the “Terms”, “CGV” in French) govern the contractual relationship between the company operating the website toulouse3dprint.fr under the brand “Toulouse3DPrint” / “Impression 3D Toulouse” and any natural or legal person (the “Customer”) wishing to purchase 3D printing services through the website.

Article 2. Scope

These Terms apply to any order for 3D printing services placed on the website toulouse3dprint.fr, whether the Customer is a private individual (consumer) or a business. Any order implies unreserved acceptance of these Terms, which prevail over any other document issued by the Customer, unless otherwise agreed in writing.

Article 3. Description of services

Toulouse3DPrint offers an on-demand manufacturing service by 3D printing, working from digital files supplied by the Customer (STL, OBJ, STEP, 3MF or equivalent formats) or designed to order at the Customer's request (computer-aided design). The materials, colours, finishes and scales available are presented on the website and may change according to the technical constraints of manufacturing.

Article 4. Quotes and orders

Uploading a file or describing a project gives rise to an indicative quote, calculated automatically or drawn up manually depending on the complexity of the request. This quote may be adjusted after a technical check of the file (actual volume, feasibility, manufacturing time). The order only becomes final once the Customer has accepted the quote and payment has been confirmed.

Toulouse3DPrint reserves the right to refuse or cancel any order whose technical feasibility is not confirmed, or whose subject matter would breach the law or the rights of third parties (see Article 12).

Article 5. Prices

Prices are stated in euros, all taxes included (TTC). They take into account the volume of material, the estimated manufacturing time, the finishes chosen and, where applicable, the shipping costs. A quote is valid for the period stated when it is issued; once that period has expired, prices may be recalculated.

Article 6. Payment

Payment is made online, securely, using the methods offered on the website (bank card or any other method indicated at the time of ordering). Manufacturing only begins once payment has been confirmed, unless a specific arrangement has been agreed for business orders.

Article 7. Manufacturing and lead times

The manufacturing lead time depends on the volume, the complexity and the number of parts ordered; it is communicated to the Customer when the quote is accepted. This lead time is indicative. If it is significantly exceeded, Toulouse3DPrint will inform the Customer as soon as possible. In accordance with Article L216-2 of the French Consumer Code (Code de la consommation), if delivery does not take place on the date indicated, the Customer may terminate the contract after a formal notice (mise en demeure) that has remained without effect.

Article 8. Delivery and collection

Depending on the option chosen when ordering, the parts ordered are either shipped to the address provided by the Customer (carrier indicated at the time of ordering) or handed over in person at the Toulouse workshop by appointment. The Customer is responsible for the accuracy of the delivery address provided.

Article 9. Right of withdrawal

In accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the Customer's specifications or clearly personalised. As parts 3D printed from a file supplied by the Customer, or designed to order at the Customer's request, fall within this exception, no withdrawal can be exercised once the order has been confirmed and manufacturing has started.

Article 10. Legal guarantees

Toulouse3DPrint remains bound by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), under the conditions of ordinary law. These guarantees do not cover defects resulting from abnormal use of the part, from a modification of the file after approval, or from dimensional tolerances inherent in the 3D printing process.

Article 11. Liability

Toulouse3DPrint uses reasonable means to ensure the manufacturing quality of the parts ordered. It cannot be held liable in the event of force majeure, the act of a third party (in particular the carrier), or use of the delivered part that does not correspond to its normal intended purpose.

Toulouse3DPrint's liability is limited to the conformity of the delivered part with the order and with the specifications provided by the Customer. Once the part has been delivered, the Customer alone is responsible for it and bears full responsibility for the use made of it. Toulouse3DPrint cannot be held liable for any consequences, damage, loss or injury, whether direct or indirect, resulting from the use, intended purpose, transformation or implementation of the parts after their delivery. It is the Customer's responsibility to check that the parts are suitable for the intended use, in particular for any technical, mechanical, structural, medical or safety application, for which our parts are not guaranteed unless agreed in writing beforehand.

Article 12. Files and intellectual property

The Customer warrants that they hold the necessary rights (copyright, trade mark rights, image rights) to any file or model they submit for printing, or that they have the authorisations required to request its manufacture. Toulouse3DPrint does not use or distribute the Customer's files for any purpose other than performing the order, unless the Customer has expressly agreed (for example, for presentation among our completed projects or in a portfolio). Toulouse3DPrint reserves the right to refuse any manufacturing that it has reason to believe would infringe the rights of a third party or the law.

Article 13. Personal data

Data provided when placing an order are processed in accordance with our privacy policy, in compliance with the General Data Protection Regulation (GDPR).

Article 14. Complaints and mediation

Any complaint may be sent to contact@toulouse3dprint.fr. In accordance with Articles L616-1 and R616-1 of the French Consumer Code, a consumer Customer who has not obtained satisfaction after a prior written complaint may refer the matter to a consumer mediator free of charge.

Article 15. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute that is not resolved amicably, and failing mediation, the competent courts shall be those within the jurisdiction of Toulouse, subject to the mandatory rules applicable to consumer disputes.
